Acceptable Use Policy (AUP)

Purpose
This Acceptable Use Policy governs your use of Bytora Tech licensed software and hosted services. Violation may result in immediate suspension or termination without refund.
Prohibited Activities
1. Illegal Activities
You may NOT use our software for:
- ❌ Any activity illegal under Jamaican or international law
- ❌ Copyright or trademark infringement
- ❌ Fraud, phishing, or identity theft
- ❌ Distribution of malware, viruses, or malicious code
- ❌ Hacking, unauthorized access, or security breaches
- ❌ Child exploitation or illegal content of any kind
2. Abuse of Service
You may NOT:
- ❌ Exceed plan limits (storage, bandwidth, domains, CPU, etc.)
- ❌ Run cryptomining scripts or bots unrelated to legitimate business purpose
- ❌ Send spam or unsolicited commercial email (UCE)
- ❌ Scrape data from our systems or other users without authorization
- ❌ Attempt to bypass security controls, rate limits, or access restrictions
- ❌ Use the service to launch attacks against other systems (DDoS, port scanning)
- ❌ Create excessive load that impacts other customers (shared hosting)
- ❌ Abuse emergency support lines with non-critical issues
3. Content Violations
You may NOT upload, store, or distribute:
- ❌ Illegal or infringing content (pirated software, movies, music)
- ❌ Defamatory, harassing, or abusive content
- ❌ Content that violates others' privacy or rights
- ❌ Phishing pages, fake login forms, or fraudulent websites
- ❌ Malicious files or executables designed to harm others
4. Account Misuse
You may NOT:
- ❌ Share login credentials with unauthorized users
- ❌ Sell, rent, or sublicense your account access
- ❌ Impersonate others or misrepresent your identity
- ❌ Create multiple accounts to circumvent plan limits
- ❌ Use stolen credit cards or fraudulent payment methods
Resource Limits and Fair Use
Each plan has specific resource limits. Violating these is prohibited:
Hard Limits (Cannot Exceed)
- Storage (5GB/15GB/50GB depending on plan)
- Domains/subdomains (1/3/10 depending on plan)
- Email sending volume (1k/5k/15k per month)
Soft Limits (Fair Use)
- Bandwidth/traffic (must be reasonable for your plan)
- CPU usage (no constant 100% CPU for hours/days)
- Support ticket volume (must be reasonable)
What happens if you exceed:
- Warning email with usage details
- Requirement to upgrade to higher plan
- Service throttled or suspended if abuse continues
Consequences of Violation
Minor / First Offense
- Written warning
- Requirement to cease prohibited activity immediately
- May require upgrade to higher plan (if resource abuse)
Moderate / Second Offense
- Temporary suspension (24-48 hours)
- Reactivation fee (J$5,000) required to restore
- Mandatory upgrade if resource-related
Serious or Repeated Violations
- Immediate and permanent termination
- No refund provided
- Data deleted immediately (no 30-day grace period)
- Legal action if activity causes harm to Bytora Tech or others
- Reporting to law enforcement if illegal activity detected
Illegal Activity
- Immediate termination
- Data preserved for law enforcement
- Full cooperation with investigations
- Potential legal action for damages
Reporting Violations
If you believe another user is violating this AUP:
Email: abuse@bytora.com
Include:
- Detailed description of violation
- Evidence (screenshots, URLs, logs, timestamps)
- Your contact information
We will investigate all reports confidentially and take appropriate action.
Examples of Acceptable Use
- ✅ Running your business operations (e-commerce, CRM, booking systems)
- ✅ Storing business data, customer records, transactions
- ✅ Sending transactional emails (order confirmations, receipts, password resets)
- ✅ Reasonable marketing emails to opted-in subscribers
- ✅ Using API integrations for legitimate business purposes
- ✅ Hosting business website or web application
- ✅ Processing payments for legitimate business
Examples of Unacceptable Use
- ❌ Sending mass unsolicited emails (spam)
- ❌ Hosting pirated software, movies, or music
- ❌ Running cryptomining scripts
- ❌ Creating phishing sites or fake login pages
- ❌ Attacking other systems (hacking, DDoS)
- ❌ Exceeding plan limits and refusing to upgrade
- ❌ Using emergency support for non-critical issues
- ❌ Sharing login with competitors or unauthorized parties
Changes to This Policy
We may update this AUP at any time. Continued use after changes = acceptance.
Governing Law
This Acceptable Use Policy is governed by the laws of Jamaica. Violations may result in immediate termination and, if applicable, reporting to Jamaican law enforcement or international authorities.
